Les présentes conditions générales de vente (les « CGV ») régissent la vente, par Eric RONCALI (le « Vendeur »), du service en ligne « Mes Invités de Mariage » (le « Service ») à toute personne effectuant un achat sur le site (le « Client »). Toute commande implique l'acceptation pleine et entière des présentes CGV.
The Service is an online tool allowing engaged couples to create a private space in which to collect and manage their guests' replies (attendance, number of guests, menus, allergies, accommodation, etc.), to edit lists and a seating plan, and to share a link / QR code with their guests. The precise features are described on the site and may change.
The Service includes a 15-day free trial, with no bank card, during which all features are open, followed by a all-inclusive plan, with no limit on guests, at the price of 49,90 € TTC in one-off payment, with no subscription or hidden fees. The all-inclusive plan may also be offered by means of a code provided by the Seller or one of its partners. The Seller reserves the right to change its prices at any time; the applicable price is the one displayed at the time of the order.
At the end of the trial, in the absence of payment or a code, the space switches to read-only mode : the Client can still view it, retrieve their data and delete it, and their guests can still reply, but they can no longer edit it or print from it until the all-inclusive plan has been paid. No data is erased solely because the trial has ended.
To date, the Service is not yet on sale: a space can only be opened with an access code, and no online payment is offered.
The order is placed online on the site. By finalising their order, the Client acknowledges having read these T&Cs and accepts them without reservation. The contract is formed upon confirmation of payment.
Payment is made online by bank card via a secure payment provider (Stripe). The Seller does not have access to the Client's bank details, which are processed directly by the provider. The Service is activated after payment is confirmed.
The space is made available to the Client immediately after payment is confirmed, and remains accessible for as long as needed to prepare the event, then for a reasonable period afterwards. The Client may archive their space; the Seller may delete the data after a period of inactivity, in compliance with applicable regulations.
Conformément aux articles L221-18 et suivants du Code de la consommation, le consommateur dispose en principe d'un délai de quatorze (14) jours pour exercer son droit de rétractation.
However, as the Service is the supply of digital content not provided on a tangible medium, performance of which begins immediately after the order, the Customer who requests immediate activation of their space expressly consents to immediate performance of the Service and acknowledges waiving their right of withdrawal dès l'activation, conformément à l'article L221-28, 13° du Code de la consommation.
“Satisfied or refunded” guarantee. Notwithstanding the foregoing, the Seller fully refunds the price paid to any Client who requests it within 15 days of payment, without having to give a reason, provided the request is made no later than 2 days before the wedding date. After this period of 15 days, or from the day before the eve of the wedding, the Service is deemed rendered and no refund is due. The request is made from the “My account” page of the space, or by email. The refund is made to the payment method used, within fourteen (14) days at most. The space then reverts to read-only.
Eric RONCALI traite des données personnelles dans le cadre du Service, dans le respect du RGPD. Pour les données des invités saisies par le Client, le Vendeur agit en qualité de sous-traitant, le Client demeurant responsable de traitement. Les modalités sont détaillées dans la Politique de confidentialité. Chacun peut exercer ses droits (accès, rectification, suppression) en contactant le Vendeur à l'adresse indiquée ci-dessus.
The Seller has an obligation of means. It endeavours to ensure the availability of the Service but cannot guarantee a total absence of interruption (maintenance, shared hosting, technical incident, force majeure). The Client is advised to keep a copy of their important information. The Seller's liability, in the event of proven damage attributable to it, is limited to the amount paid by the Client for the Service. The Seller cannot be held liable for the consequences of improper use by the Client or their guests.
La marque « Mes Invités de Mariage », le site, les textes, visuels et le logiciel demeurent la propriété exclusive de Eric RONCALI. Aucune reproduction ou réutilisation n'est autorisée sans accord écrit préalable. Le Client conserve la propriété des contenus qu'il saisit.
The Seller cannot be held liable for failure to perform its obligations in the event of force majeure within the meaning of article 1218 of the Civil Code.
For any complaint, the Customer first writes to the Seller at the address eric.roncali@gmail.com or by post to the registered office. The Seller undertakes to reply as soon as possible.
Conformément aux articles L612-1 et suivants du Code de la consommation, le Client consommateur qui n'a pas obtenu satisfaction dans un délai de deux mois après sa réclamation écrite peut recourir gratuitement à un médiateur de la consommation. Les coordonnées du médiateur dont relève le Vendeur sont communiquées sur simple demande à l'adresse ci-dessus.
These T&Cs are governed by French law. Failing an amicable resolution, any dispute will fall to the competent courts under the conditions provided by law.
This article applies to wedding professionals (caterers, photographers, DJs, reception venues, officiants, planners…) who open a supplier space. The other articles remain applicable to them, except those reserved for consumers (articles 7 and 13).
15.1 Supplier space. Opening and using the supplier space is free of charge. It is reserved for registered businesses: the supplier provides their company name, SIRET number and the address of their establishment, and keeps them up to date, in particular in the event of a change of structure.
15.2 Checking of registration. The SIRET number is checked against the Sirene register at sign-up, then regularly. If the establishment no longer appears there as active, the space is suspended while a check is made and the supplier is informed. If the situation is not resolved, the couples it is linked to may be told that its business appears to be closed.
15.3 Data of couples and their guests. The supplier only has access to the information that each couple chooses to share with them, and cannot change it. They undertake to use it only to prepare the wedding concerned, not to pass it on to third parties and not to keep it beyond what their service requires. Dietary requirements and allergies are sensitive information: they are only passed on to a supplier for the guests who have agreed to it. Without this agreement, the supplier cannot take them into account and cannot be held liable in this respect. The couple can close this access at any time.
15.3 Link with the caterer’s software. When your caterer is Services Traiteur and you have entrusted your meal to them, Mes Invités de Mariage passes to their management software, solely for the preparation of your meal, your seating plan (first name and initial of your guests' surname), the number of your guests per meal, their dish choices, and the dietary requirements and allergies of only those guests who have agreed to them being passed to suppliers (tick box on their reply page, at the time they enter them). Your guests' contact details, your budget and your other data are not passed on to them. Closing this caterer's access or removing them from your list stops the transfer immediately. This information is kept by Services Traiteur until the end of the service, then deleted within 3 months, unless legally required otherwise.
15.4 Credits. A credit opens a full space for a couple. The supplier can give them away or resell them to their clients. The price of a credit, all taxes included, is the one shown in the supplier space at the time of the order, with a discount depending on the number of credits bought at once. Each purchase is invoiced. As this is a sale between professionals, there is no right of withdrawal; a credit already used to open a space is neither taken back nor refunded. A credit handed to a couple and used to open a space is consumed: it remains due and is neither taken back nor refunded. Only unused credits can be taken back and refunded, at the unit price at which they were bought.
15.5 Disputes between professionals. Tout litige relatif au présent article relève des tribunaux compétents du ressort du siège de Eric RONCALI.
